DMPQ: Preamble is a part of the constitution or not. Comment

.  Preamble represent the core theme of the constitution. Preamble is the most precious part of the constitution. It is the proper yardstick with which we can measure the worth of the constitution. It is based on the objective resolution adopted by constituent assembly.

Whether preamble is a part of constitution or not was firstly decided in the Berubari case. In this SC gave the ruling that preamble is not part of the constitution and it is not amendable. The judgement got reversed in Keshvanand bharti case. In this court ruled that Preamble is the part of the constitution and it is amendable. Consequent to this 42nd amendment made changes in the Preamble. Socialist, secular and integrity words were added to the preamble.

The same judgement got sanction in the LIC Case, 1995. Hence, As of now preamble is a part of the constitution and is amendable. But Preamble is neither a source of power and is not enforceable in court of law.
